A trademark partner works under the direction of the chief, and provides legal support to both technical and business clients. A trademark partner provides legal support for national and foreign patent generation and patent portfolio maintenance. Further, a trademark partner also provides legal support for existing company-related agreements as well as those that the company will pursue. Additionally, a trademark partner provides support for patent clearance/freedom-to-operate decisions, as well as for company-aligned third party patent assertions and standards activities.
A trademark partner should have ability to negotiate and draft complex agreements, including research, development, university and non-disclosure agreements. A trademark partner requires preferable experience in writing non-infringement and invalidity opinions. Experience in conducting patent clearance analyses is preferable for a trademark partner job. In addition, a trademark partner also requires experience in analyzing third party patent assertions and conducting defensive patent infringement negotiations.
